Recent trends in business ethics along with growing attacks upon unions, suggest that employee rights will be a major social concern for business managers during the next decade. However, in most of the discussions of employee rights to date, the very meaning and legitimacy of such rights are often uncritically taken for granted. In this paper, we develop an account of employee rights and defend this conception against what we take to be the strongest in-principle objections to it.

This second festschrift for Robert Sokolowski brings together papers given in April 2000 at a colloquium on the occasion of his sixty-fifth birthday. In contrast with the first festschrift in honor of his sixtieth birthday, which was mostly phenomenological philosophy, the present collection is mostly phenomenological theology.

Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. The unfinished Scito teipsum (“Know thyself,” also known as the “Ethics”; c.1138) analyses moral action. (shrink)

Here are two meritorious and well-produced works devoted to the dialogue between Buddhism and Christianity. They also have in common a certain desultoriness which left me reflecting on the limits of the rhetoric of 'dialogue.' Having taken over from 'liberation' as a theological buzzword, 'dialogue' seems by now to have exhausted its usefulness. William James remarked that everything genuine will somewhere become a sham. Lip service to a vague ideal of dialogue becomes a substitute for the unmet challenge of Buddhist-Christian thought, and the less the dialogue is practiced the more its importance is verbally celebrated. The retention of the word 'dialogue' may even serve to keep the religious other at a comfortable distance: it is more reassuring to say, "Of course we are in dialogue with the Buddhists" than to say "We are facing up to the challenge Buddhist thought poses to Christian theology," for in the former statement the Buddhists remain conveniently located others, sitting across the table, rather than a troublesome, potentially subversive presence within our own intellectual world. [End Page 315]In their submission to the recent Roman synod of Asian bishops, the Japanese bishops made much of their commitment to interreligious dialogue, and this was acclaimed with enthusiasm. But the impression left by Karin Amell's book (a doctoral thesis in missiology) is that not very much is going on in this area in Japan, the country seen as "the promised land of dialogue" after Vatican II (p. 119). "One has the impression that it is an activity for a few specialists" (p. 145), leaving the ordinary faithful largely untouched. Amell apparently does not read Japanese, so there may be much that she has missed, yet for my part I can think of nothing to add to the factual content of her account. For the spiritual side of the encounter she focuses on three Japanese pioneers, now in their seventies (pp. 150-191): Kadowaki Kakichi, SJ, Okumura Ichiro, OCD, and Oshida Shigeto, OP. To what extent these men have succeeded in creating a widespread Catholic Zen culture remains unclear, but Amell believes the "dialogue of religious experience" is the most widespread form of Buddhist-Catholic interaction in Japan (p. 146). As to scholarship, which is not Amell's direct concern, one has the impression that everyone is too busy with church and university affairs to devote their time to this. The scholarly labors of Heinrich Dumoulin, for example, have not been continued by anyone else. Despite the work of a powerful Catholic foundation, the Nanzan Institute for Religion and Culture (p. 141), Buddhism does not seem to excite Catholic intellectuals in Japan. Japanese Catholics are a small community, numbering about half a million. But given the high number of theologians, clergy and religious (p. 137), one would expect a more intensive interaction with local religious traditions. Instead the focus of theological interest remains fixed on Western sources. It is not so much that the situation of a small church in the midst of secularized-polytheistic-Buddhist Japan fails to give food for thought as that people seem afraid to think out its implications. Those engaged in contemplative sharing with Buddhists seem to avoid intellectual issues. David Bohm, Emeritus Professor of Theoretical Physics at Birkbeck College of the University of London and Fellow of the Royal Society, died of a heart attack on October 29, 1992 at the age of 74. Professor Bohm had been one of the world’s leading authorities on quantum theory and its interpretation for more than four decades. His contributions have been critical to all aspects of the field. He also made seminal contributions to plasma physics. His name appears prominently in the (...) modern physics literature, through the Aharonov- Bohm effect , the Bohm-EPR experiment , the Bohm-Pines collective description of particle interactions (random phase approximation), Bohm diffusion and the Bohm causal interpretation of quantum mechanics, also sometimes called the de Broglie-Bohm pilot wave theory. David Bohm was born in Wilkes-Barre, Pennsylvania on December 20, 1917. A student of J. Robert Oppenheimer, Bohm received his Ph.D. from the University of California at Berkeley in 1943. In 1950 he completed the first of his six books, Quantum Theory, which became the definitive exposition of the orthodox (Copenhagen) interpretation of quantum mechanics. Here Bohm presented his reformulation of the paradox of Einstein, Podolsky, and Rosen. It is this Bohm version of EPR which has provided the basis for the enormous expansion of research on the foundations of quantum theory, focusing on nonlocality and the possible incompleteness of the quantum description (the question of “hidden variables”), which has occurred during the past several decades. This paper examines the nature of ‘reasonable’ argumentation in Generation of Animals III.10. Its aim is to develop an alternative to the dialectical construal of reasonable argumentation in Aristotle recently favoured by Robert Bolton. On the basis of a close textual analysis I show that the reasonable arguments deployed in Generation of Animals III.10 do not appeal to endoxa or reputable beliefs per se. Instead, they rely upon general facts about animals established by empirical induction. This implies that, contra (...) Bolton, not all reasonable arguments in Aristotle are dialectical; some, in fact, are thoroughly empirical and scientific. I conclude by suggesting that such empirical reasonable arguments even have a place in the De Caelo, the treatise that Bolton primarily focused upon when developing his interpretation. (shrink)

That two theories of law are different does not imply that they differ in all aspects. Far more likely is the opposite state of affairs, namely, that there are some common points along with some points of disagreement. I will start with three points in which there seems to be at least some connection between Joseph Raz’s opinions and my own. In a second step, I will consider what is, perhaps, the most fundamental difference.

Jewish historiographical production of the Renaissance and Baroque periods was in fact the expression of the unsuccessful attempt by a handful of individuals to make sense of Jewish history as a living history in diaspora conditions. Their failure was the inevitable result of the essential incompatibility of the subject matter of history, in those days conceived mainly as political and military narrative, and the destiny of their people the world over. Jewish historiographic output can be seen as part of the (...) Jewish endeavor to redefine Jewish identity at the dawn of the modern era. However, the time had not yet come for a "New History" among both Jews and non-Jews -attempted in particular by Joseph ha-Cohen, David Ganz, and most perhaps most successfully by Azariah de Rossi-which might have provided a possible answer to the crisis of Renaissance historiography. Hamerton-Kelly Stanford University We French cannot really think about politics or philosophy or literature without remembering that all this— politics, philosophy, literature—began, in the modem world, under the sign of a crime. A crime was committed in France in 1793. They killed a good and entirely likable king who was the incarnation (...) of legitimacy. We cannot not remember that this crime was horrible... When we speak about writing, the accent is on what is necessarily criminal in writing. (Jean-François Lyotard, "Discussion Lyotard-Rorty" 583; quoted in Dunn 165) The condemnation ofthe king is at the crux ofour contemporary history. It symbolizes the secularization of our history and the disincarnation of the Christian God. (Albert Camus, The Rebel 120; quoted in Dunn 140) Susan Dunn makes a well-documented case that the death of Louis XVI was unconsciously understood, especially by the Jacobins, as a human sacrifice that was necessary for the founding of the republic. "Louis must die because the patrie must live," said Robespierre at the king's trial, and the representative Carra considered Louis "the source of corruption and servitude... the fatal talisman ofall our ills" whose death would cause the people to be "regenerated in morality and virtue" (Dunn 15-37). The king was a monster and the source ofall the ills, and his death 68Robert G. Hamerton-Kelly had the power to alleviate those ills and regenerate the nation. This image of the king as sacrificial victim persisted throughout the first half of the nineteenth century in French literature and politics, sometimes assimilating itself to the image of Jesus Christ who died for the sins of the world. Legitimist writers like Joseph de Maistre saw his death precisely in this light as a great Christian sacrifice that would do France and the world good (Dunn 28-37). The king as a sacred monster whose life causes all ill and whose death brings healing is the classic figure of the scapegoat or sacrificial victim identified by René Girard. Susan Dunn recognizes this but because she does not know Girard's mimetic theory she is not able to explain the significance of the scapegoat king. Her work is, indeed, as Conor Cruise O'Brien says in the foreword, a work ofdemonstration rather than argument, of evidence rather than interpretation. I offer a mimetic interpretation ofthe Jacobin claim that the death ofthe king was the human sacrifice that founded the republic, and an argument that a universally operative generative mechanism forged the historical events of the revolution.1 There is no essential difference between the sovereignty ofthe king and the sovereignty of the people. In both cases sovereignty arises from a metaphorical contract that threatens death to anyone who violates it. The royal metaphors are organic while the revolutionary metaphors are legal and rational, but they all express the sacrificial structure ofpolitical power. Revolutionary democracy imports the fiction ofrationality to obscure its sacrificial structure. The desire ofthe general will for contractual equality is a transformation of mimetic desire in search of a victim around which the bad violence ofmimetic rivalry can coalesce into the good violence of sacred order. Sovereignty, therefore, is structurally single and simple; it is violence transformed through the sacred into the powers oforder. Max Weber understood this in general ifnot in its particulars when he defined sovereignty as the monopoly of the means of violence within a single territory.2 1 Mimetic theory was discovered by René Girard. Next SectionMedical ethics and law education in the UK is undergoing continuous transformation. In parallel, human rights teaching with respect to health is expanding as a distinct field. Yet a resistance to the inclusion of human rights in the medical ethics and law curriculum persists. In response to Stirrat and colleagues, this article seeks to highlight the mutual benefit that could be derived from an integration of human rights into the already established medical ethics and law teaching in medical schools. It proposes that incorporating human rights into the curriculum would add value to traditional medical ethics and law teaching and provide a promising opportunity to enhance the interest from the student body. Este trabajo tiene como objetivo general examinar los elementos que conforman el no-positivismo inclusivo; postura epistemológica y filosófica desarrollada a través de los años por Robert Alexy. Los métodos empleados son el deductivo, analítico y dialéctico; la principal técnica utilizada ha sido la investigación documental. El presente documento, grosso modo, se encuentra dividido en tres apartados. Primero, son explicados los elementos que conforman el no-positivismo inclusivo de Robert Alexy. Segundo, se explican algunas críticas formuladas a los elementos constitutivos (...) del no-positivismo inclusivo con base en las ideas de Riccardo Guastini, Juan Antonio García Amado, Joseph Raz, Eugenio Bulygin, Matthias Klatt, Carlos Bernal Pulido; entre otros autores. Por último, en tanto objetivo particular, se expone una reflexión con el propósito de indicar uno de los múltiples caminos que los estudios jurídico-científicos sobre el no-positivismo inclusivo podrían seguir en el porvenir.
